Suspect accused of killing Officer Jobbers-Miller declared competent to stand trial

An attorney for Wisner Desmaret said a doctor has evaluated his client and it was decided he is competent to proceed in the murder trial.

Fort Myers Police Department Officer Adam Jobbers-Miller, 29, was shot in the head in the line of duty on July 21, 2018, and Desmaret pulled the trigger, investigators say.

Desmaret is accused of taking the officer’s gun during a struggle at a gas station before shooting him. Witnesses said Desmaret ran back to the gas station after he shot Jobbers-Miller, where more gunfire was exchanged with other officers before he was arrested. Desmaret has been in custody since the night of the shooting.

He faces a murder charge and the state is seeking the death penalty.

At a previous hearing, his lawyers argued that he has extensive mental health history. But prosecutors said competency is a legal term, not a medical term.

During the hearing on Tuesday, it was decided more depositions needed to be done.

The next court date is pre-trial on Jan. 5, 2021.

Jobbers-Miller, a firefighter turned police officer, worked for the Fort Myers Police Department for nearly three years. He hailed from the township of Wayne, New Jersey, where he was a graduate of Wayne Valley High School.
