Oscar Thompson, the man accused of abusing his dog, went in front of a judge today and now his attorney is arguing the case should be thrown out.

Right now, Chance the dog is healthy and working as an official deputy dog for Sheriff Marceno.

Thompson’s attorneys filed a motion to dismiss the case. They argue that the dog’s conditions were not enough to fit the charges.

Thompson was arrested for the abuse of Chance back in May when he was found with his mouth taped shut along with several other injuries including puncture wounds found on his body.

His attorneys argue that there isn’t enough evidence to show that Thompson had committed acts of animal cruelty.

Chance was adopted and made an official deputy dog by Sheriff Marceno and the Lee County Sheriff’s Office.

Back in May, Sheriff Marceno made this statement about those who abuse animals.

“I have a zero-tolerance to any kind of abuse and I will dedicate whatever resources necessary to enforce exactly that.”

Because Thompson’s attorneys filed a motion to dismiss the case, they have scheduled another pretrial for Wednesday, Nov. 9.
