A man convicted of driving recklessly and causing a deadly crash in Cape Coral was sentenced to 12 years in prison followed by three years of probation.

A jury found him guilty of vehicular homicide for a crash that killed Kennya Ojeda in 2017.

Graves was driving 64 mph. near Veterans Parkway and Country Club Boulevard in Cape Coral when he lost control, jumped a median and slammed into Ojeda’s car.

The state argued that because Graves has previous felony convictions the judge should secure stricter sentencing and asked for 15 years.

Graves’ friends and family also testified, arguing that he’s changed since those felony charges and used his time in jail to better himself.

The judge looked at case law before determining whether or not Graves’ past convictions make him eligible for a longer sentence. Ultimately, the judge decided not to consider Graves a habitual felony offender.
