Dunbar sludge site. (Credit: WINK News) There are new developments in the federal lawsuit over the Dunbar sludge site. The plaintiffs, people living near the site, have filed a second amended complaint against the City of Fort Myers. The eight counts in the new complaint revolve around claims of negligence, diminished property values, the city not cleaning up the site for decades and the push for a court-supervised fund paid for by the City. It would allow for medical monitoring of people living near the site who have been exposed to arsenic as a result of the sludge dumping. The suit asks for class action certification claiming more than a hundred people are party to the lawsuit and requests a jury trial.
