Victim takes gun away from suspect after being pistol-whipped

A victim took a handgun away from a Cape Coral man after being pistol-whipped by the suspect twice in the face.

The suspect, Gordon Smith, 42, faces charges of Aggravated Battery with a Deadly Weapon and Aggravated Assault with a Deadly Weapon without Intent to Kill.

A female homeowner invited the victim to her home at the 2000 block of NE 33rd Terr. in Cape Coral. Smith, a co-owner who was eating in the kitchen, became upset by the victim’s presence and started yelling at him.

Smith told the victim he was going to retrieve a handgun, according to the Cape Coral Police Dept. press release, returning with a black Titan .25 caliber handgun. Smith would strike the victim in the face twice with the gun.

Then, the victim took away the gun from Smith and fled the house to call authorities. Later on, an Officer took the handgun, which was loaded with six rounds but had an empty chamber, per the press release.

Smith has been taken to Lee County Jail.
