The woman convicted of defrauding Lee County taxpayers out of $5 million is filing an appeal.

Kay Gow said evidence at the trial against her company, VR Labs, did not show that she acted with intent.

Her husband Robert Gow and business partner John Williams took a Lee County grant and promised VR Labs would create jobs.

But they never delivered on that promise.

Kay and Robert were found guilty on all 10 counts tied to VR Labs, and Williams was convicted on three of five counts.

Robert was found dead earlier in March. His death was ruled a suicide.
