Former Naples teacher returns to court, gets upgraded charges

Brock Elliot Smith, a former teacher and assistant coach in Naples, returned to court this morning to enter a plea to the judge.

Smith is accused of sending nude photos to a victim in November 2016 and twice having sex with her in a bathroom stall, according to a Collier County Sheriff’s Office arrest affidavit.

Smith’s charges were upgraded to Second-Degree Felony for soliciting sex from a minor via internet. He entered a plea of No Contest to that charge and could face up to 15 years behind bars. The sentencing hearing will take place on May 9.

Charges for Sex with a Minor were also upgraded, form second-degree to first-degree felony.

Smith did not accept a ‘global plea’ on all charges and is expected to go to trial on the Sex with a Minor charge.

The victim has missed court proceedings, like depositions, and will be summoned to explain why before a judge next month.
