Former Naples High teacher accused of sex with a student backs out of plea deal

New developments in the case against a former Naples High School teacher and football coach.

Brock Smith is accused of having sex with a teen in a bathroom and sending a naked picture of himself to another.

He was expected to take a plea deal Friday morning, but didn’t.

A plea deal did not happen today.

The State Attorney’s Office told Smith’s attorney there’s new information that would enhance the charges in both of cases.

After his lawyer relayed this message of possible ramped up charges. Smith decided he wants more time to decide what to do.

The information that the state has would take the current two second-degree charges of sex with a minor to first-degree.

And the two third-degree charges in the second case, of soliciting sex from a minor, to second degree.

If none of these cases are resolved then both could end up going to trial.

Smith is due back in court Tuesday.
