Jury seated, opening statements given in child pornography trial

FORT MYERS, Fla. Opening statements were made Friday in the trial of a man accused of possessing lewd images of a 9-year-old he is suspected of kidnapping.

Prosecutors are not allowed to associate Jorge Guerrero as a suspect in Diana Alvarez’ disappearance, but they can use interrogation video where Guerrero discloses their sexual relationship.

Former Federal Prosecutor Doug Molloy believes attorneys on both sides will need to work very hard to keep everyone in line.

“[Attorneys should] prepare their witnesses for trial, not necessarily on the truth of what they’re saying, but to avoid any mention of any other criminal investigation or activity that would cause a mistrial,” he said.

Friday’s statements followed a challenging jury selection process. Potential jurors either know about the case or have seen fliers of the missing girl.
