SEATTLE- A woman claims a community clinic gave her a flu shot instead of a birth control injection, and now she is suing the federal government.

Yesenia Pacheco filed the civil lawsuit in U.S. District Court against the government since the clinic is federally funded.

Pacheco, who decided to keep the child, loves her 3-year-old daughter, Sandra but said she was born because of negligent hospital staff.

According to KIRO, Pacheco was getting the Depo-Provera birth control injection every three months. In September 2011, she went in for the shot but she claimed was instead given a flu shot. Her attorney’s have a chart showing she was billed for the flu shot.

“I asked what happened,” said Pacheco. “They said you are 2 1/2 months pregnant. You don’t have to have it. You won’t have to pay anything.”

Pacheco’s daughter was born with a brain malformation, which affects her motor and speech skills. She is now suing for an unspecified amount, which she said is to pay for the medical bills and pain and suffering.
