Naples man arrested for pointing laser at deputy car

NAPLES, Fla.- Pointing a laser at cars is a serious crime and one Naples man found out the hard way.

For 20-year-old Brandon Stephenson it was a game. His mother, Carola Stephenson , tells WINK News her kids grew up playing with lasers in the car; she says they would point them at signs.

“It was just for fun,” said Brandon Stephenson. “I use it in dark places.”

His laser was a Christmas gift from his mom two years ago.

“I can’t. I am going to cry,” said Carola Stephenson as a tear runs down her face. “I have been holding it in for a while and I am just really upset.”

Never did she think a laser would lead to her son’s arrest. “They should be sold with a warning.”

Brandon spoke exclusively with WINK News after bonding out of jail.

“I think it is excessive,” said Brandon Stephenson. “He followed us for awhile before he pulled us over. He could of pulled us over at any time.”

According to the arrest report, Stephenson and his friend were turning at the intersection of Immokalee Road and Oil Well Road when an off duty Hendry County officer saw them shooting a laser at his car.

“I was pointing it straight,” said Stephenson, “the car was bouncing and I can’t keep it steady. It kept hitting him I guess.”

The mother’s of both men say they want all laser companies to put a warning on the lights.

Norma Ribisi’s son was in the car with Stephenson when he was arrested. “My son knocked on my door and said his friend was arrested. I was like, ‘are you kidding me?'”

Stephenson was the only one arrested. He is facing a 3rd degree felony and could face up to 5 years in prison.

“We didn’t know the law,” said Stephenson’s mother. “If we did, we would of taken it away from our children. I started reading about it. I was in shock to believe that something like that could happen.”

“They made it such a big deal; it was just a toy,” said Stephenson.

WINK News reached out to criminal law firm to find out just how serious the charges can be.

Zach Cantor with Viacava and Cantor says in the state of Florida:

-Pointing a laser at a car or aircraft is a 3rd degree felony can get you up to 5 years in prison.

-Pointing a laser at a car or aircraft causing injury is a 2nd degree felony and can get you up to 15 years in prison.

-Pointing a laser at an airplane is a federal charge. It can get you up to 20 years in prison and a fine of $250,000.
