I am a divorced mother of 3 children. One 5 year old daughter with special needs. My four year old daughter Angela who is missing, and my infant son who is 5 month old. I was married to David Bernal in May of 2003. Our divorce was finalized in August of 2007. I had a daughter previous to the marriage and I had angela during the marriage. We had gone through a bitter divorce and custody case. After the divorce was done in September of 2008 David was arrested for Domestic Violence and in December plead guilty to four charges of Domestic violence agianst myself. In January of 2008 I moved to Florida with my children, with the agreement that Angela(since we still had joint custody)would go back in March of 2008 for a visit. I was taken back to court by my ex husband because he tried to say that i had not told him where i had gone with her but the court in Arizona denied his claim and told us to still go ahead with the order until something was filled permentantly. I agreed to send angela to arizona with the provision that he stay in Arizona.(he and his mother has threatened to take her) after angela being with him for only about 3 and a half weeks i got a phone call on June 18th from Angela stating she was leaving with Daddy and not coming back. David then got on the phone and told me that he was in fact leaving in about a week to go to Idaho. I told him i would be there in a couple of days. After finding a sitter and the money to get to Arizona i filled emergency sole custody paperwork. Arizona granted my emergency claim on June 30th. On july 7, 2008 the judge continued the order for another 45 days to try to give him a chance to return her to me. While all this was going on I found out David has several warrents in Arizona for misc stuff including not completing the Domestic violence Class, or anything else as well as unrelated charges. I also found out david had shaved angela's hair off. he says because of lice i belive that it was to change her apperance. I was told that court would be set for september 2, 2008 where a final order would be set. David did not show or call for any of the hearings meanwhile tormenting me with texts and several phone calls with my daughter crying. One september 2, 2008 I was granted permanment full sole custody of Angela as well as an order for all law enforcement agencies to help me obtain physical custody. I called the Cape Coral PD on September 3 when the orders were faxed to me and they put her into the NCIC data base as a missing and endaged person. We found out David was in Idaho so that is where the hunt took us next. Cape Coral Police Dept. contacted the Kuna Idaho sherriffs office who said they would help locate and pick up my daughter. Well David once agian moved to Nama Idaho. I had got in touch with Nampa ID Police Department and told them what was going on only to find out that they had already spoken to david but did not pick up angela and that they had the address to where she was but refused to help. On September 4th i once agian contacted the Nampa Sherriff's office and I spoke with a Depuy Dowell. He had me fax all my paperwork to him and let me know that he would pick up angela if that is what i wanted but to be warned he would have to place her in juvinille detention till i got there or i could wait to have him pick her up until i got there. I told him to pick her up. He went to Prosecutor Brian Nevell in Nampa Idaho and Mr Nevell told him to pick her up and contact children and families until i could get there. I recived a phone call from that deputy staying his seargent had said that it needed to go to a different prosecutor because Nevell was to new and so they would not pick up angela until a new and older prosecutor (the supervisor) looked at it and "crossed all T and dotted all I's" I did not hear back from them till i called the state police after trying to get the FBI involved. I was told that there were several steps i needed to do until they could get involved the next step was to call the Idaho State police. which i did. I was told to fax all paperwork to them and they would contact Nampa to do what they were supposed to do. I called back at 5 pm Idaho time (7 pm here) and was told that they talked to nampa and to wait till they called. Not even 10 minutes from hanging up with them did Nampa PD call back and inform me that until i file more paper work there they will leave angela with my ex husband despite the fact she is in NCIC and that they will not uphold my ruling of custody. I am a single mom I do not have the legal resources to help me file the paperwork for this and legal aid wil not help me. I am in the process of finding a lawyer to sue Nampa Id police department as well as Nampa Id city. SHE IS IN THE NCIC AND NOBODY WILL HELP ME WHY? ????? If anyone can help get me attention with this story I am willing to fax any and all paper work to anyone or if anyone knows of an attoney who can help me get the paperwork together i will be etenally gratefull. I mean what if it was your child and noone was willing to help. No amber alert no nothing...what would you do????
