FORT MYERS, Fla. - A United States Supreme Court ruling and U.S. - Cuba relations are partly responsible for accused cop killer Abel Arango being on the streets of Southwest Florida. That is the word from United States Immigration and Customs Enforcement, also know as ICE.
A spokeswoman from ICE tells WINK News, the Supreme Court ruling in the case Zadvydas vs. Davis forced Immigration and Customs Enforcement's hand. The ruling said that if a person cannot be deported from the United States with 180 days of their deportation order, they must be let out of jail.
Arango is Cuban. Because of strained relations between the United States and the island nation, deportation back to Cuba is nearly impossible in just 180 days.
The Supreme Court ruled the person released due to their Zadvydas vs. Davis ruling may be placed under supervision when released. The problem with that ruling is that ICE does not have any supervision arm.
The ICE spokeswoman explained Cuban nationals that have served their term in jail are often put back on the streets. If they were from nearly any other country, they would be deported.
