SOUTHWEST FLORIDA - New information in a child abuse investigation that ultimately ended in the murder of the girl's mother.
WINK News has learned that the DCF investigator on the case lost her job for not notifying police about the alleged sexual abuse of the 14-year-old girl.
The documents show that DCF learned on May 20th that the 14-year-old was allegedly being sexually abused by her stepfather. A call came in to the hotline. But DCF says tonight that the investigator failed to do her job, to follow up and to notify police.
What did happen: two days later, DCF investigator Nikol Anderson finally contacted the mother by phone and told her to tell the stepfather Robert Deleon to leave their North Fort Myers home.
Just hours after that phone call, police say Ruben Deleon shot and killed his wife 35-year-old Jeanette Deleon and pistol-whipped the 14-year-old fracturing her skull.
The report says he found out that the teen had reported she was being abused.
The Department of Children and Families says the investigator should have called police and Jeanette Deleon should have confronted her husband with law enforcement at her side.
"I think this was a train wreck waiting to happened no matter what. But she should have called law enforcement. She should have done her job and we will never know what would have happened "IF". said Cookie Coleman of The Department of Children and Families.
Also in this case, a North Fort Myers high school teacher Eric Zuspann was charged with not reporting the abuse after the girl told him about it back in May.
The teen and her 6-year-old half-sister are in the care of a relative.
DCF says that all hotline calls are now being reviewed by a supervisor, but that this was a case of an individual who failed, not the system.

So the DCF case worker gets fired; but a really good and caring teacher who tried to help get arrested? Where is the justice in that scenario??

well, cookie "get the red out" coleman is at it again, the answer to everything is to get rid of substandard workers; who defy the command of getting everying off the books and have no rollovers the next month. It's never about the children/families, they will continue to suffer as long as the goal is just about the numbers of cases on the books. Her motto: get em closed and off the reports...sure, she is concerned about how she looks to the Suncoast Tampa office...wake up WINK TV and get on it.

The responsibility starts with parents to protect our children. If we were doing our jobs raising our children to be responsible, mature and intelligent we would hear a lot fewer heart breaking stories like this one. I am not saying the mom is to blame, she was a victim too. But if your going to lay blame then you have to include family members , neighbors and any one else who knew about this from the beginning. The teacher was a good start. The last person to blame is the DCF worker.

Chalk another one up for DCF. I have had first hand experience with. Our family went in and reported death threats made towards my babies. These were written, documented and reported to LCSD as well. Guess what....its not illegal, nor is it deemed important by DCF. Way to be proactive DCF! You can have the red flags flying...but if nothing is done, what good are you doing. How many kids have fallen through the cracks in the last few years??

It is sad what happened to this family and may God Bless them but, I am sure N. Anderson didn't plan this. As a one year dcf worker trying to fit in at the department where over half the staff has been there for 10,15 and 20 years (burned out) and able to give advice-- it's horrible that Anderson ended up with this burden on her shoulders for life. So, now she is a victim too. This area is one of the largest transit areas in the world with families needing dcf services--Who's in charge?

You all do not know what it's like to work for DCF..The media only looks at what the investigator did not do. All of the facts were not presented and until then, no blame should be pointed at the investigator. It's easy to say she's at fault but I know first hand how it feels to be overwhwlmed with dozens of case with no support. Yeah sure LCSO could take over but at leat they have more resources and when they respond to a call they go out in pairs..DCF CPI's go out alone and with out protection

Well as I see the DCF is someone who wants to know all of your business and use it against you to form a case but when it comes 2 the kids being there ggetting abuse and the parent can't do anything but send a message with the kids 2 school 2 let someone know about it 2 seek help then everyone back down and have nothig 2 do with it until it is 2 late. Please if the kids come 2 you for help it is a reason they will come 2 you maybe her mother can't and she need help also.LISTEN 2

Instead of spending the hundreds of thousands of dollars for Charlie Crist and Alex Sink to trot around the world talking/learning about global warming, how about throwing that taxpayer money where its really needed to keep the kids of Florida safe. Charlie and Alex are in a global coma. Time to wake up, stop dreaming about rock star status and do the job we elected you to do!!!

It is so easy to sit on the sidelines and judge people. All complainers should work directly in a position of hearing abuse claims from children and see how and if they can do a better job. There is and always will be uncertainties in some abuse claims and would be completely impossible for anyone to predict the outcome every time. No one should have the authority to believe every case heard and just take away children form their parents without clear evidence of abuse. Kids sometimes lie.

No child should fall through any cracks the blame is on dcf we as community reported the abuse they don't care even with the burns on the children.

I have seen first hand how the DCF works and kids fall through loop holes. It is sad a situation. But This time it is not just DCF's fault. You have neighbors, school teachers, family members that is also to blame. This abuse didn't happen just one and more people knew about it and done nothing. AND The mother of the child that got killed that is very sad also, but why didn't she call the cops to help her get him out of house, she knew he would react violent. The community and DCF are to blame!!!

Shame on you Nikol Anderson. Isn't resigning or getting fired from DCF an easy way out for you? I think it's time for DCF employees to know they have the responsibility to take their job seriously. Nikol has a women's murder on her hands. She shouldn't be allowed to walk away so easily.

Nice. They need to do some serious house cleaning. I thought DCF in Chicago was bad, this is disgusting. How many more people will die before something is done?

Where was the supervisor? Aren't risk assessments required to be submitted within 24 hours of report receipt? Didn't the OPA or supervisor observe that the case had not been commenced? Time for the Lee County Sheriff's Department to take over child abuse investigations in Lee County!!
