Immokalee students suspended and transferred to alternative school

IMMOKALEE - Four Immokalee High School football players accused of rape are now out of police custody, but they won't go back to their school. The victim's family says she won't go back either because they're moving out of town.

Arrest reports say the girl initially claimed the boys raped her. But, later she told deputies she consented to having sex with the four boys. Florida law says anyone under the age of 16 can't give consent and the boys were arrested for lewd battery.

The principal of Immokalee High School decided all four boys would be suspended from school for ten days, then transferred to an alternative high school. That also means the boys will no longer be allowed to play football.

Meanwhile, the victim's father says his daughter isn't returning to Immokalee High, either. They've rented a moving van and are leaving Collier County by tomorrow night. The father says his children just aren't safe here. He tells WINK NEWS he will sue the Sheriff's Office and the School district for not protecting his daughter.

A neighbor of one of the football players says they should be able to go back to school.

"It's unfair," says Helen Franklin. "All of them seem to be very nice boys."

The State Attorney's office hasn't decided if they'll charge the teens as adults.
