Boat owner working to change ordinance

CAPE CORAL, Fla. - One Cape Coral man wants the same rights as RV owners - the opportunity to get a temporary parking permit for his boat, but the city won't let him. They say if his boat is going to be outside, it needs to be in his backyard, and not on his driveway.

Darren has received six citations from Code Enforcement in the past two years. He said,

"If I bring my boat home and do maintenance, repair work, or cleaning in the driveway, I am in violation of the city of Cape Coral ordinance," said Darren.

The ordinance states all boats need to be parked in the backyard, not on the side or in front of a house. RV owners don't have to follow the same regulations. They can get a temporary parking permit, and that's exactly what Darren's fighting for - in a place he calls a boating paradise. He even took the issue out of the water, and onto the internet.

"I've received over three dozen responses of other boaters owners here in the city of Cape Coral supporting the (ordinance) change," Darren said.

The city says it has been an ongoing controversy, but most boats stay on the water - so there's not a big enough problem to change the ordinance.

Frank Cassidy, Division Manager of Code Enforcement said, "If someone is washing their boat on their driveway, we won't issue an ordinance for that ... but if they're storing it for days, then yes - they're in violation of the ordinance."

There is no limit to the amount of warnings a boat owner can be issued, but if the boat isn't moved after three days of being cited, the offender will be charged a fee or get towed.
