COLLIER COUNTY, Fla. - The Collier County Sheriff's Office arrested a man that they shot two weeks earlier. Jose David Giracca, 30 of East Naples was arrested Friday after being released from Lee Memorial Hospital. He was shot by Collier County Sheriff's Deputies the morning of November 14th.
Giracca is charged with two counts of aggravated assault on a law enforcement officer. He has also been placed on an immigration hold by Immigration and Customs Enforcement. Federal officials say Giracca overstayed his visa.
Deputies say they shot Giracca after he approached them during a routine traffic stop at Gulf Gate Plaza. Deputies say Giracca pulled out a gun and did not drop the gun when deputies order him to do so. Instead, he apparently pointed the gun at Deputies. The Deputies opened fire on Giracca, hitting him numerous times.
The gun turned out to be a pellet gun, but looked very similar to a pistol.
The Sheriff's Office says Giracca's next of kin appear to be in Argentina.
