COLLIER COUNTY, Fla. - WINK News talked to the attorney representing the man shot by deputies last Friday.
James Chandler says deputies fired at his client, Jose David Garacca more than 30 times, hitting him more than eight times. Now, Chandler is asking the Sheriff's Office why so many shots had to be fired.
Deputies say Garacca approached them at Gulfgate Plaza in Naples early last Friday morning and pulled out a pellet gun. They say it looked like a semi-automatic handgun. The Sheriff's Office says when Garacca wouldn't put the gun down, the three deputies opened fire.
"Why one shot could not have repelled the alleged threat, why it took eight or nine shots that actually hit him and a possibility of 30 or 40 that were fired," says Chandler.
In a statement to WINK News, the Sheriff's Office wouldn't comment about how many shots were fired, but say the deputies acted appropriately. The Sheriff's Office says deputies are "trained to shoot until the threat is neutralized."
Meanwhile, Garacca is in critical condition in the ICU at Lee Memorial Hospital. He has been charged with aggravated assault.
The three deputies who shot Garacca have been placed on administrative leave pending the outcome of the investigation.
