LEE COUNTY, Fla. - Starting Tuesday, it will be illegal to sell, use or possess the hallucinogenic plant known as salvia in Florida.
Salvia may sound familiar to you. There are hundreds of varieties of salvia and many can be found in your garden, like sage.
The one that's illegal is called 'Salvia Divinorum' and it's the active ingredient called Salvinorum A that can cause a hallucinogenic high.
Don't worry, it's not likely you have the illegal variety of salvia growing in your garden.
Workers at the Estero nursery, Driftwood Garden Center, say Salvia Divinorum was not commonly sold at nurseries. But that didn't stop people from asking about it.
We stopped by a few tobacco shops in Fort Myers. Shop owners did not want to go on camera, but tell us they used to sell a lot of salvia months ago, especially after customers saw how people reacted to the drug in videos posted on video sharing web-sites like YOUTUBE.com.
However, ahead of the new law, some shops stopped carrying salvia a month ago.
The new law in Florida puts salvia in the same class of illegal drugs like marijuana and LSD.
The Lee County Sheriff's Office and the Fort Myers Police Department say they haven't had a lot of run ins with the now illegal drug. It's now on their radar and they tell us they intend to prosecute to the fullest extent of the law if someone is caught with it.
If Salvia is found in Southwest Florida, it will be sent to the Florida Department of Law Enforcement's crime lab in Fort Myers to be positively identified.
"We have identified an extraction process which we will use in order to extract the chemical component that's the active ingredient in salvia," explained Mary Jane Havener, FDLE crime lab supervisor.
Havener says FDLE has been working with crime labs in other states where salvia has already been outlawed to come up with an appropriate identification process for Florida.
FDLE in Jacksonville is working to validate the process and it's expected to be complete by August.

yay! another drug to add to the list. It's not like the drug war was ever successfull and it's only cost us about 50 billion a year. Anyone can get any drug they want EASILY! They will never outlaw alcohol because it would have a major economical impact. Job loss from beer companies and hops plantations. Wineries would be illegal. Wine tasting even would be illegal. Alcohol is interwoven into our society as well as drugs. If the government legalized it they would also be able to tax it. $$$$$$

Studies have shown that Salvia divinorum is not addictive or habit forming. Its mechanism of action indicates that it is actually anti-addictive. Many people have reported that Salvia divinorum helped them to overcome Severe Depression or substance abuse problems. This has included addictions to alcohol, caffeine, crack, cocaine, heroin, marijuana, methamphetamine, nicotine, and XTC. Even after over 40 years of scrutiny the plant is still considered harmless. It has no lingering effects like a

What's the point in banning salvia? Are they afraid we're gonna get behind the wheel like we could with alcohol which is LEGAL? I'm sorry, but there is no chance someone can drive when they smoke salvia. I know for a fact that people have seen the Youtube videos. They sit on the couch and trip out. But I guess that must be worse than getting drunk and beating your wife, since salvia is now illegal. Good call, Florida.

People think that having a law made makes up for having a loved one die. It doesn't. Those parents are trying to shift the blame away from themselves. Salvia is strong but only lasts a few minutes. It's like outlawing whipped cream cans.

I guess the Law Enforcement Lobby won out. They found another 'drug' to go after and arrest folks on, to destroy lives. Ironic, since Salvia has been scientifically proven to be Anti-Addictive, and Completely Nontoxic. Not to mention there have been Zero deaths, accidents, or overdoses nor does it have any long term negative effects. It has actually been used to successfully treat Cocaine and Meth addiction as well as Severe Depression. Way to go Gov Crist!
