Collier Court rules against Marco Island ordinance

Marco Island, Fla. - Anchoring off the coast of Marco Island is now legal again.

Back in January David Dumas intentionally broke a new city ordinance to prove a point.

Some islanders complained they didn't want boaters anchoring near their property, so city council created the new rule.

The rule said boaters can't anchor for more than six days and less than three hundred feet off the coast. State law doesn't set a time or distance limit.

Judge Rob Crown ruled in favor of the existing state law.

"We need to be encouraging visitors, not pushing visitors away," said Dumas

Bill McMullen was one of the islanders who originally brought the issue to city council.

Some complained of excessive noise, and waste being dumped overboard.

"We'd like to see some sort of buffer if you will, to provide the home owners for this kind of activity," said McMullen.

Supporters of the new city law say they plan to appeal the judge's decision.
