Phone company responds to 'Sexy Poker' game on cell phone

Fort Myers, Fla. - A popular Christmas gift for teens could have some naughty games on it.

A Virgin Mobile cell phone pre-loaded with strip poker was featured on WINK News at 11 Wednesday night.

Virgin Mobile says it's up to parents, not a phone company, to look after what games children are playing on their cell phones.

The 'Sexy Poker' game is not fully revealing but is set to sexy music and has provocative talk from scantily clad women. Those graphics include the women tied up to poles or bent over a car saying you have win to get them to take off some clothes.

A statement from Virgin Mobile today cites their terms of service which you must agree to before activating a phone. In part it says, "...content may be unsuitable for children/minors; unreliable or inaccurate; or offensive, indecent or objectionable."

It goes on to say the buyer is solely responsible for evaluating that content. Of course, that sentence is buried in more than 12 printed pages of a service agreement and some 43 paragraphs into the document so it's hard to find in the fine print.

For the record, though, Virgin Mobile says it would be happy to provide a refund or replace the phone with one that doesn't have strip poker on it.




RESPONSE FROM VIRGIN MOBILE USA:
With regard to the the preloaded game on the Wild Card, we encourage parents to determine what is age appropriate for their children, and strongly support them taking an active role in learning about the technology their children are using. The following language appears in our Terms of Service, necessary to accept in order to activate any Virgin Mobile USA phone:

"Mobile services available through VirginXL or VirginXtras and your Virgin Mobile phone may allow you to access the Internet, text, pictures, games, graphics, music, email, sound and other materials ("Mobile Content") and send Mobile Content elsewhere. Mobile Content may be: unsuitable for children/minors; unreliable or inaccurate; or offensive, indecent or objectionable. You are solely responsible for evaluating the Mobile Content accessed by you or anyone using your Virgin Mobile phone. We strongly recommend you monitor data usage by children or minors. Prior to accessing certain content which may be inappropriate for children/minors, we may require you to provide certain personal information in order to verify that you are at least 18 years of age."

If the customer is unhappy with the content or operations of the phone, we are happy to provide a refund or replace the phone with another handset that does not have this material preloaded.
