Contest Rules

1. How to Enter the Contest:

a. The WINK NEWS/INFINITI OF FT.MYERS Grand Opening Giveaway will be conducted from September 14, 2009 until September 27, 2009 at 9 p.m. for the Boca Raton Resort & Club Weekend Getaway. The Car Giveaway will be conducted from September 27, 2009 until October 15, 2009 at 12pm. The winning entry will be drawn at random from all qualifying entries for the Boca Raton Resort & Club Weekend Getaway on Monday, September 28, 2009 and The winning entry will be drawn at random from all qualifying entries for the Car Giveaway on October 16, 2009.

b. To participate in the contest, viewers will need to watch WINK NEWS at 6AM Weekdays, September 14, 2009 through October 15, 2009 and identify the “INFINITI OF FT.MYERS “Grand Opening Giveaway” Code Word” and Boca Raton Resort & Club “Weekend Getaway” Code Word of the day. Viewers can then officially enter the qualifying “INFINITI OF FT.MYERS “GRAND OPENING GIVEAWAY” or “Boca Raton Weekend Getaway” Code Word” on the official entry form available at 1) WINK NEWS.COM or 2) Showroom of INFINITI OF FT.MYERS (14990 Tamiami Trail, Fort Myers, FL 33912)

c. Only one entry per person per daily “INFINITI OF FT.MYERS “GRAND OPENING GIVEAWAY” Code Word.”

2. Eligibility Restrictions:

a. The contest is open to all WINK TV viewers ages 18 and over who reside in the total survey area as defined by Ft. Myers, Naples Nielsen Media Research Report (Counties include: Lee, Collier and Charlotte, Hendry, Desoto and Glades). Employees of BOCA RATON RESORT & CLUB, their affiliated entities, affiliated advertising agencies, and participating sponsors/promotional partners, INFINITI OF FT.MYERS, LLC/ SE AUTOMOTIVE GROUP/GWINNETT AUTOMALL, LLC/ FL WESTCOAST AUTOMOTIVE, LLC and WINK TV, its licensee, Fort Myers Broadcasting Company, their affiliated entities, affiliated advertising agencies, participating sponsors/promotional partners, other television stations and radio stations in the total area as defined by Fort Myers/Naples Nielson Media Research report area and the members of their immediate families are ineligible to participate or win.

b. All entries become the property of INFINITI OF FT.MYERS and BOCA RATON RESORT & CLUB and may be used for marketing purposes.

3. Prizes:

a. The winner of the Car Giveaway contest will receive the 2009 Infiniti G37 Sedan valued at $31,142, or of the date of this publication, with VIN# JNKCV61EX9MO14522. The Weekend Giveaway contest package is valued at $900, or of the date of this publication

b. Contest prize is not transferable. Proof of a VALID Driver’s License, ID and current insurance required.

c. Winner must receive delivery of vehicle from the Infiniti of Ft. Myers lot by Friday, October 23, 2009. Weekend Getaway accommodations are valid through December 23, 2009, subject to availability.

4. Selection of Winners:

a. Decisions of station management with respect to the contest are final.

b. Winner will be selected by random drawing from all eligible entries. The random drawing will be on September 28, 2009 and October 16, 2009 at the INFINITI OF FT. MYERS dealership located at 14990 Tamiami Trail Fort Myers, FL 33912. The winner will be announced on WINK-TV, WINK NEWS, and WINKNEWS.COM. The winner will also be contacted by phone.

5. Conditions:

a. The winner will be responsible for all applicable local, state and federal taxes; fees; and licenses, and liability and physical damage insurance on the vehicle. Winner of the BOCA RATON RESORT & CLUB WEEKEND GIVEAWAY is responsible for all taxes, incidentals and gratuities.

b. WINK and INFINITI OF FT.MYERS provide no training or instruction of operation; and the winner assumes all risk of injury or death to himself and any passengers and holds FMB and INFINITI OF FT.MYERS, LLC/ SE AUTOMOTIVE GROUP/GWINNETT AUTOMALL, LLC/ FL WESTCOAST AUTOMOTIVE, LLC, BOCA RATON RESORT & CLUB, and their affiliated entities harmless from any and all liability associated with the use or operation of the vehicle or accommodations and/or incidents at the resort.

c. By participating in the contest, the winner agrees to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and to sign a publicity release prior to acceptance of the prize.

d. Pursuant to the liability release; Contest winner will agree to hold WINK TV, its licensee, Fort Myers Broadcasting Company, their affiliated companies, INFINITI OF FT.MYERS, LLC/ SE AUTOMOTIVE GROUP/GWINNETT AUTOMALL, LLC/ FL WESTCOAST AUTOMOTIVE, LLC, BOCA RATON RESORT & CLUB and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest.

e. WINK TV, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of the WINKNEWS.com Web Site or who is otherwise in violation of the rules. The station further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.

f. WINK TV reserves the right to make changes in the rules of the contest, including the substitution of a prize or prizes of equivalent or greater value, which will become effective upon announcement.

g. No purchase is necessary. Vehicle is subject to change based on availability. Accommodations are subject to availability. The contest is void where prohibited.

h. Failure to comply with the contest rules may result in a contestant’s disqualification, at the sole discretion of WINK TV.

i. WINK TV is not responsible for typographical or other errors in the printing, the offering or the administration of the contest or in the announcement of a prize.

j. The winner will be responsible for providing VALID Driver’s license, ID, certificates of liability and physical damage insurance on the vehicle as a condition precedent to taking delivery of the vehicle.
