The pedestrian who was killed has been identified as Jemel Gardener of Lehigh Acres. Another pedestrian, 22-year-old Mark Caton, was taken to Lee Memorial Hospital in critical condition.

The Florida Highway Patrol arrested 26-year-old Christopher Best on DUI charges.

The 34-year-old driver of another vehicle involved was taken to Bayfront Hospital in Punta Gorda with minor injuries.

FHP said the pedestrians were pinned between the vehicles.

Witnesses said Best was speeding when he hit a vehicle and two men who were working in a construction zone. According to his arrest report, Best said he didn't see the vehicle or the men.

The results of his breath test were .214, according to FHP.

The crash shut down the southbound lanes of U.S. 41, and both lanes of Melbourne Street, but those lanes have since opened up.
