FORT MYERS, Fla.- A local man filed a lawsuit this morning, to get his name on the State Representative ballot this election year.

Democrat Larry Aguilar and some of his supporters held a rally outside the Lee Justice Center in Fort Myers.

Aguilar claims his qualifying papers made it to the Tallahassee post office well before the filing deadline, but the state elections office was negligent, in not picking up the mailing. Thus, he is not on the ballot for State Representative, District 79.

"I think these guys are doing things wrong. You know, we often get bad word about how we do things in this state, and this is gonna be another black eye, and it is not warranted," said Aguilar.

The lawsuit against the elections division asks for a judge to issue an injunction, to put Aguilar's name on the ballot.
