LEE COUNTY, Fla.- A woman accused of leaving a child unattended in a pool is about to go on trial for his death. Christian Byrd was at day care when he died last year.  

Jury selection was completed Tuesday, and opening statements began later in the afternoon for his former day care provider, Melissa Smith.

It was a full courtroom with family members, jurors and attorneys inside.

Byrd's mother answered no when asked if she knew how many kids where at the house when she dropped off her son.

She and her husband also say they had no idea there a pool at the day care facility, and would not have let 2 year old Christian go to the facility if they knew one was there.

Smith is charged with aggravated manslaughter after allegedly leaving four children unattended in a pool at her Lehigh Acres day care. One of those children, 2-year-old Christian, later drowned in that pool.

Smith's daycare facility was registered with the state during the time of the incident.

The family has said from the start they just want justice.

The trial will resume Tuesday morning and is expected to wrap up on Thursday. Count on WINK News to bring you more as this case develops.
