LEE COUNTY, Fla.- The state rested its case Wednesday, after calling Dustin Jaye's cell mate to the stand.
"Dustin said he had the knife, the uncle was screaming, yelling stick her, stick her."
Brian Frost, revealed a chilling conversation he had with cell mate, and accused killer Dustin Jaye, about the night Debra Striano was murdered.
Prosecutors say Jaye killed Striano in July 2012 for money, that Striano's boyfriend Russell Myers bragged about having in the home.
"Dustin said ma'am we aren't here to hurt you, we just want the money," said Frost.
But Frost claims Jaye says it was his uncle, Billy Ray Retherford, who killed Striano.
"Dustin said he went to top drawer of the dresser and then when he looked back his uncle was straddling her and cut her throat," said Frost.
Retherford later died in a shootout with police.
The defense came back biting, called Frost "a jail house snitch" and pointed out inconsistencies in his testimony, and a possible motive.
Ed Kelly, Jaye's attorney said, "You're hoping that the prosecutor will reduce your sentence, isn't that true?"
To which Brian Frost replied, "I'm not really banking on it sir."
Earlier in the day, jurors heard a phone call Jaye made to his sister, Ashley and his mom from jail, also claiming his innocence.
"Because I already know I didn't do that s*** bro. So I've been doing a lot of thinking. If I have to man, I'll do 5 to 10 years, you know what I am saying," said Jaye.
Allison Jaye, his sister, took the stand again first thing this morning and it was the defense's turn to ask questions. They had Allison Jaye admit she was on drugs during the events leading up to the murder, and that she often lied when taking drugs. She also admitted to lying to police the night of the murder, acting as Dustin Jaye's alibi, but when asked by the prosecution, Allison said she took an oath and did not lie on the stand yesterday.
A crime scene investigator showed the jury burnt sneakers she had found in an air vent from Jaye's home. Their soles matched bloody footprints found at the scene.
The court also saw a black knife handle investigators found in Suncoast Estates. A blade was found not too far from that handle. In openings, the prosecution says Jaye went to hide the knife used in the attack.
The defense plans to call one witness to the stand. The judge told the jury he expects them to deliberate sometime Thursday afternoon.
The State also plans to call Jaye's cellmate to the stand. He said Jaye confessed to the whole thing.
