CAPE CORAL, Fla.- Former Cape Coral Mayor John Sullivan took the stand in a Lee County courtroom, determined to win back his seat. He lost by just 121 votes last November, and claims misconduct during the election.

Sullivan said everything from voting officials to votes themselves are in his words "funky" and he is leaving it up to Judge Alane Laboda to determine whether or not he should get his seat back.

There has been no word on whether the judge is expected to render a verdict today. She could rule that the election was not conducted properly and that could potentially lead to a new election, or she could say that Marni Sawicki won fair and square and this matter is over.

Judge Alane Laboda has requested both sides to submit proposed judgements to her by Friday at noon. She says she will review them and render a verdict from chambers.
