FORT MYERS, Fla.- A Cape Coral realtor accused of scamming investors out of million of dollars avoided jail time Tuesday.

Greg Eagle was set to be sentenced Tuesday, but the judge put that off when Eagle said he wanted to withdraw his guilty plea. Originally, Eagle signed a plea deal admitting to mortgaging property in a land deal gone bad that cost 52 investors millions of dollars.

In court, Eagle said that he's innocent, and apologized to an investor right in front of our cameras.

"It is going to work out. This class action lawsuit is going to help. I think you've know me long enough. I'm not out to hurt the investors," said Eagle.

Sentencing was delayed until December 23rd.

Eagle told WINK News he feels he won a personal victory.
