TALLAHASSEE, Fla. (AP) - A Duval County man may get his time in prison shortened because a judge talked about his religious beliefs before handing down a sentence.
The 1st District Court of Appeal ruled Wednesday that Percy Torres should be resentenced by a new judge. Torres in 2011 was sentenced to 30 years in prison for sexual battery.
During his trial, the judge mentioned he was Catholic and said he assumed Torres was also Catholic. The judge stated at one point that Torres did not act the way that people who are Catholic should act.
The appeals court said that the statement made it appear that Torres was given a maximum sentence based on religious beliefs.
The court in the same ruling rejected Torres appeal to overturn his conviction.
