FORT MYERS, Fla. - Yousel Rivera sat stone faced in a Lee County courtroom on Tuesday as the man he admits to shooting testified. Cape Coral officer, David Wagoner told the court he never thought the 2011 traffic stop would end the way it did. Officer Wagoner told jurors he believed Rivera intended to kill him. The state alleges Rivera opened fire on Wagoner during that traffic stop as Wagoner attempted to question him. Wagoner was hit three times. Two bullets hit Wagoner's bullet proof vest. The third went under the vest, entered Wagoner's abdomen and exited his lower back. Wagoner says he has returned to work but continues to have medical problems related to the shooting. Rivera, charged with first degree attempted murder of a law enforcement officer, could spend the rest of his life behind bars if convicted.
