FORT MYERS, Fla.- Cape Coral Police Officer David Wagoner testified in court today, against the man accused of shooting him during a traffic stop in 2011.

The jury was seated in the in the First Degree Attempted Murder trial this afternoon. The six jurors and two alternates consist of five men and three women.

The defense will argue Rivera suffered from ADHD for most of his life and may have been suffering from a form of epilepsy on the night he shot Officer Wagoner. A doctor for the defense says those conditions may have clouded Rivera's ability to know right from wrong.

The trial is expected to last a week.
