CAPE CORAL, Fla.- The City of Cape Coral is moving forward with a multi-million dollar lawsuit against Lee County Electric Co-op. The lawsuit is over who should pay for the moving of power poles along main roads, such as Del Prado and Santa Barbara Boulevard.
The City paid LCEC more than $2.5 million to move those power poles during road construction, but now it wants the money back.
"I think that if there is a recovery to be made, and it will benefit the citizens, and that money will actually go to the citizens? Then yes, it should be pursued," said Cape Coral resident Bruce Sturch.
The City won a similar lawsuit filed against LCEC in 2005. It was upheld by an appeals court last year.
