BONITA SPRINGS, Fla.-  Two are in custody following an overnight shooting in Bonita Springs, according to the Lee County Sheriff's Office.  

According to deputies Jose Huerta, 19 of Estero and a 17 year old accomplice from Bonita Springs approached two male victims near the intersection of Hampton Street and Old 41 Road late Friday night.  Huertas allegedly shot one of the victims when he tried to defend himself. The other victim was not injured.

The wounded victim has been identified as Marcelino Bartolo, 33 of Bonita Springs.  He is currently in stable condition following surgery, according to Sergeant Stephanie Eller.

On September 7, 2012, at 10:55 pm, the Lee County Sheriff's Office received a report of a shooting near the intersection of Hampton Street and Old 41 Road in Bonita Springs. Deputies responded to the scene and located a victim with gunshot wounds.

The investigation revealed the victim and a friend were walking south on Old 41 Road when they heard voices behind them. They turned around and saw two men. One of the men had a gun pointed at them.

The victim removed his belt to defend himself and swung it at the gunman. The belt buckle hit the gunman’s accomplice in the head. The gunman then shot at the victim striking him more than one time. The gunman and his accomplice fled the scene and the victim was transported to the hospital for medical treatment.  His condition is unknown at this time.

A witness in the area saw two men running and then enter a vehicle shortly after hearing gunshots. The witness had seen these men exit the same vehicle shortly before the hearing the shots being fired. The witness called 9-1-1 to report the suspicious activity and to provide a description of the men and the vehicle.

Deputies converging on the area saw the vehicle traveling north on Three Oaks Parkway near Estero Boulevard. Both of the men were in the vehicle and were positively identified as the men that accosted then shot the victim.

Due to the nature of the incident, detectives with the Lee County Sheriff's Office Major Crimes Unit assumed the investigation. Based on their investigation the shooter and his accomplice have been arrested for Aggravated Battery with a Deadly Weapon and are identified as follows:

The other suspect is a minor.

During the investigation is was discovered that Jose Huerta had an outstanding Violation of Probation warrant for Misdemeanor Battery, Petit Theft and Resisting a Merchant. Huerta is facing these additional charges as well.
