PUNTA GORDA, Fla.- An Englewood woman, found guilty of disturbing a sea turtle nest in 2010, will not be serving any time in prison.

Juanita Schultz faced up to five years in prison, but was adjudicated not guilty. Instead, she was sentenced to 24 months probation, 100 hours of community service and will have to pay $500 in restitution.

Her attorney Andrew Banyai hinged his defense on the idea there was never a real nest on her Englewood property.

Banyai told WINK News that the 76-year-old is in bad health.

The state was not happy with the sentencing.
