LEE COUNTY, Fla.- Nineteen year-old Dylan Wisniewski was crying as he told the court what happened when he shot his 15 year-old girlfriend to death in his bedroom.
"I ran out to my dad and he said what was that. I said Ashlee got shot. He said c'mon Dylan this ain't nothing to be joking about. He said I'm not joking," said Wisniewski.
He called 9-1-1 but it was too late. After she died, he told police he was with Swayze when he pointed a gun at the wall. Wisniewski says the shooting was all an accident.
His attorney asked him if he knew the gun was loaded or why Swayze ended up in front of the barrel. He answered no to both questions.
But prosecutors say he knew how to handle a gun and knew what he was doing could kill someone.
"What do you think is going to happen when you point a gun with your finger on the trigger at a 15 year old? Unfortunately, we know what happened," said Assistant State Attorney Marie Doerr.
It took jurors about 45 minutes to return a verdict. Wisniewski will be sentenced March 5. He faces up to 30 years in prison.
