TALLAHASSEE, Fla. (AP) - The Florida Supreme Court says nursing home arbitration agreements that limit remedies in conflict with those allowed by state law are invalid in two separate cases.
The justices ruled an appellate court erred by requiring arbitration over allegations of negligence against the nursing homes instead of letting them go to court.
Both cases were decided by 5-2 majorities.
In each case the arbitration agreements included bans on punitive damages that are allowed by state law.
The majority in each case said that's contrary to public policy and undermines remedies set by the Legislature.
The complaints were filed against nursing homes in Carrollwood and Winter Haven.
