Cape Coral officer in fair condition after shooting, gunman in custody

CAPE CORAL, Fla. - Cape Coral police say Officer David Wagoner is in fair condition after being shot three times at point-blank range following a traffic stop early Saturday morning. 

The accused gunman, Yousel Lopez Rivera, 20, of Cape Coral, is in the Lee County Jail on charges of attempted first degree murder of a police officer.

Cape police say Rivera was a passenger in the vehicle during the stop along Santa Barbara Blvd near Pine Island Road just before 1am Saturday.  Ofificer Wagoner made contact with the a 17 year old female driver, then asked Rivera for his ID.  Wagoner was shot as he walked around the vehicle to get Rivera’s information.

Investigators say Rivera shot Wagoner three times at point blank range. Two of the bullets struck the officer vest. The third hit him in abdomen below the vest. Wagoner was able to return fire, but did not hit anyone.  The officer was able to radio for help as the suspect's vehicle sped away.

Police believe Rivera took control of the car and crashed into a home off Santa Barbara Blvd.  The female in the car was injured, along with one person in the house.  Police say Rivera then took off on foot.  K9 units tracked him down a short time later, hiding inside a garbage can.

Rivera has been arrested and charged with Attempted First Degree Murder of a Police Officer. The female has not been charged.

Wagoner is a four year veteran of the Cape Coral police department.
