LEE COUNTY, Fla - Michelle Freiburger appeared in court Tuesday to face culpable negligence charges.
Back in January, she left a loaded gun in her nightstand. Her 2 year-old grandson Ian got a hold of it and shot himself in the head. He died later in the hospital.
WINK is learning more about the investigation tonight after the Department of Children and Families released its final report. Freiburger refused to cooperate with its investigation.
Freiburger's roommate told police she moved the gun from her nightstand, but it was later moved back. The toddler's parents were also not aware a gun was in the house.
Ian Heath, Sr. told DCF case workers that he and his wife are so devastated over their son's death, they've been drinking alcohol and smoking marijuana to cope with the pain.
Heath was arrested for DUI back in February.
Freiburger is not allowed to have unsupervised visits with the Heath's surviving grandchild.
She is due back in court in September.
