CAPE CORAL, Fla.- Cape Coral Police arrested James Buday, 31, after they say he caused permanent damage to his infant by shaking him because he wouldn't stop crying.

According to his arrest report, Buday brought the unconscious infant to the Cape Coral Fire Department around 2:15 p.m. on July 9th. The child was then transported by ambulance to Health Park Hospital. The baby suffered head trauma, intracranial hemorrhaging and needed respiratory assistance. Due to the severity of the injuries, the infant was taken by helicopter to Miami Children's Hospital, where he remains in critical condition.

An evaluation revealed old and new hemorrhaging to the brain and retina, again according to the report. The Child Protection Team said that this was an "obvious case of child abuse."

On Friday, police say Buday admitted that he just "snapped" and shook the baby front to back and side to side until he was gasping for air. When the baby stopped crying, Buday said he put him in his crib, only to return later to find him unresponsive.

According to the Miami Children's Hospital, the victim is "neurologically devastated with permanent damage" and it is unknown whether he will survive.
