NAPLES, Fla.- Collier County Sheriff's deputies arrested Dyempfly Devariste, 24, on Tuesday for aggravated assault after he allegedly threatened to kill a man who was not interested in buying his iPhone 5 from him.
Deputies met with the victim, who said Devariste wanted to sell him his iPhone 5 and drove him to Radio Shack to verify the phone's value. Upon returning to his residence, the victim told Devariste he did not want to buy the phone from him. This reportedly angered Devariste, who pulled a black pistol out of the trunk of his vehicle. The victim said Devariste yelled at him while holding the gun and threatening to "blow his brains out." According to the arrest report, Devariste continued to threaten the victim, before getting into his vehicle and fleeing the scene.
A witness corroborated the victim's story.
Deputies made contact with Devariste around 3:00 p.m., at a home on the 2000 block of 55th St. SW. They located the iPhone described by the victim and witness. After further investigation, detectives found probable cause to arrest Devariste, and transported him to the jail without incident.
