NORTH FORT MYERS, Fla. -  A jury decided Lee County was not responsible for Tempe O'Grady's death.

Four years ago, O'Grady was in her motorized wheel chair when she was crossing the intersection of Bayshore and Hart road. Halfway across the intersection she was hit by a car and killed.

Her daughter, Cerice, sued the county claiming she would still be alive if the broken light in the crosswalk had been fixed. It was broken due to a previous accident.

Lee County said repairs were underway and O'Grady took an unnecessary risk by crossing into oncoming traffic.
