FORT MYERS, Fla. — Attorneys for Mark Sievers asked a judge to remove the possibility that his client will face the death penalty.

Sievers is facing first-degree murder charges for the 2015 killing of his wife, Dr. Teresa Sievers, at their home in Bonita Springs. Attorney Greg Mazur argued Tuesday that the court should strike the state’s notice of intent to seek the death penalty because he said it wasn’t filed soon enough.

“They’re asking to take my client’s life,” Mazur said. “That’s asking a lot. And if they’re going to ask that, then they need to follow the statutes.”

The judge didn’t rule on the matter Tuesday, but he denied a separate request from Mazur to release grand jury testimony.
