WINK News found out the truck is driven for Davenport’s Nursery in Naples. An owner of the Nursery tells us the driver is one of their mechanics and has since been disciplined.

Watch the video to see what the truck’s owner has to say about the aggressive driving caught on camera.

LEHIGH ACRES, Fla.- The video is crystal clear. A driver in a Blue Toyota, cuts off another driver on State Road 82.

A few minutes later, he attempts to pass the two cars in front of him, almost running a school bus off the road!

“School bus driver actually did a great job of evading that vehicle, by pulling on to the shoulder. We could have had a head on crash,” said Lt. Greg Bueno, of the Florida Highway Patrol.

The video was posted to Youtube, and WINK News played the shocking scene for Lt. Bueno.

“You can just tell, he’s driving in an aggressive manner. He’s crowding the center line, you can tell he’s in a hurry. He’s attempting to pass multiple vehicles at one time,” said Lt. Bueno.

Lt. Bueno says this driver, could be in trouble for several violations, including improper passing, it would lead to a fine of $160.

“It could potentially lead to an aggressive driving school, or an enhancement of points.”

Or worse.

“If it’s to the capacity willful or wanton, reckless driving, it could lead to an arrest,” said Lt. Bueno.

The problem is, law enforcement wasn’t around, so the driver won’t get fined.

While Lt. Bueno doesn’t recommend putting yourself in danger to get video of another driver, if you want to call FHP, and report someone on the road, you can.

“If we did see that behavior, we would take any appropriate law enforcement option we would have to,” said Lt. Bueno.

The aggressive careless driving statute just went into effect in 2013. Under the law, the offense carries a fine of $100 the first time, up to $500 the second time around.
