NFL player Nate Allen plans to sue FMPD after mishandling of investigation

FORT MYERS, Fla.- A major development in the high profile investigation of NFL star Nate Allen.

WINK News obtained new documents that show Allen will sue the Fort Myers Police Department. His attorney Sawyer Smith says he hit the department with a letter of intent late this week. It was only two pages. “It’s a violation of his civil rights,” says Smith as to while they sent the letter. “It’s very straight forward. FMPD does not get to go around the law.”

By law, it gives the department 6 months to respond and if nothing happens, they plan to move forward with a lawsuit.

Police detained Allen in February after an underage teen accused of him of exposing himself to her on US 41.

The State Attorney’s Office later cleared Allen, saying he didn’t do anything wrong.

Allen’s lawyer, Sawyer Smith, just served paperwork to FMPD of its intent to sue the agency.

Allen, who went to Cape Coral High School, is now with the Oakland Raiders.
