Convicted child rapist to get new trial

FORT MYERS, Fla.- A convicted child rapist will get a new trial in May.

Prosecutors say Richard McDade raped a girl from the time she was 10, until she was 16.

That’s when the teen used an MP3 device to secretly record two conversations between herself and McDade to use as evidence against him.

Florida’s Supreme Court ordered a new trial after ruling that those records should not have been used in court, since it’s illegal to record conversations in Florida without consent from the other party.

Now, a new bill being proposed in Tallahassee would allow secret recordings to be used in the courtroom only in cases of sexual abuse of a child 16 years old or younger.
